The Responsible Person Duty: What the Law Requires
The Regulatory Reform (Fire Safety) Order 2005 is the primary fire safety legislation for commercial premises in England and Wales. The assessment must identify fire hazards, evaluate the risks to people, and record the significant findings.
The Fire Safety Act 2021 extended the scope of the 2005 Order to include the structure, external walls and flat entrance doors of multi-occupied residential buildings — affecting commercial landlords and mixed-use building owners. The Building Safety Act 2022 introduced further duties for ‘higher-risk buildings’ (18m+ or 7+ storeys).
Failure to comply with the Regulatory Reform (Fire Safety) Order can result in an enforcement notice, a prohibition notice (shutting down the premises), an unlimited fine, or up to two years’ imprisonment for the most serious cases.
