The Legal Framework for HMO Landlords

The Regulatory Reform (Fire Safety) Order 2005 (RRO 2005), Article 9 requires the ‘responsible person’ for any non-domestic premises — including the common areas of an HMO — to conduct a suitable and sufficient fire risk assessment and implement appropriate fire safety measures. Under Article 3, the responsible person is the HMO landlord or, where there is a managing agent, that agent. The duty cannot be delegated away from the person in control of the premises.

The Housing Act 2004, Part 2 introduced mandatory HMO licensing for properties with 5 or more occupants forming 2 or more separate households over 3 or more storeys. Many local councils have extended licensing to smaller HMOs through additional licensing schemes under Housing Act 2004, Section 56. As a condition of any HMO licence — mandatory, additional or selective — local authorities routinely require evidence of a current fire risk assessment.

The Management of Houses in Multiple Occupation (England) Regulations 2006 require HMO managers to maintain means of escape from fire in good order, ensure fire-fighting equipment and fire alarms are maintained, and take reasonable steps to protect occupants from injury. These obligations apply regardless of whether the property is licensed.

The Smoke and Carbon Monoxide Alarm (Amendment) Regulations 2022 require landlords to install at least one smoke alarm on every storey of the property and a carbon monoxide alarm in any room with a fixed combustion appliance (including a gas boiler). These requirements are in addition to — not instead of — the interlinked alarm systems required under HMO licensing conditions.

Mandatory HMO licence conditions under Schedule 5 of the Housing Act 2004 and local authority licence conditions typically require: FD30 fire-rated doors to all habitable rooms in the escape route, interlinked Grade D Category LD2 or LD1 alarm systems, emergency lighting in common areas, fire blankets in kitchens, and minimum room sizes (currently 6.51m² for a single adult, 10.22m² for two adults sharing).
