Legal Requirements for Landlords

The Regulatory Reform (Fire Safety) Order 2005 (RRO 2005), Article 9 requires the ‘responsible person’ to conduct a suitable and sufficient fire risk assessment for the common parts of all multi-occupied residential buildings — including HMOs, blocks of flats, and converted houses. Under Article 3 of the RRO 2005, the responsible person is the person in control of the premises: for a rental property, this is the landlord or their managing agent. The duty is ongoing and cannot be delegated away. Failure to carry out a fire risk assessment is a criminal offence carrying an unlimited fine and, in serious cases, up to two years’ imprisonment.

The Housing Act 2004 and the Housing Health and Safety Rating System (HHSRS) require local authorities to assess fire safety in privately rented homes. Under the HHSRS, fire is a Category 1 hazard — the most serious. Local councils can take enforcement action where fire risks are not properly managed, including issuing improvement notices and prohibition orders.

The Smoke and Carbon Monoxide Alarm (Amendment) Regulations 2022 (in force from 1 October 2022) require all private landlords in England to install: a smoke alarm on every storey used as living accommodation, and a carbon monoxide alarm in any room with a fixed combustion appliance (including gas boilers). Alarms must be tested at the start of each tenancy and repaired or replaced when reported as faulty. These requirements apply to all rental properties, including those that are not HMOs and do not require an HMO licence.

Is a fire risk assessment legally required for a single buy-to-let property?

For a single-household tenancy in a self-contained house or flat, the RRO 2005 applies to common areas of the building (e.g. shared hallways, stairwells in a block of flats). For HMOs, it applies to all common areas. Even where the RRO does not apply, the Housing Health and Safety Rating System (HHSRS) and lending/insurance requirements mean a documented fire risk assessment is strongly advisable for all rental properties.

Who is the responsible person under the RRO 2005?

Under Article 3 of the Regulatory Reform (Fire Safety) Order 2005, the responsible person for a rental property is the landlord, or a managing agent who has taken on full control of the premises. Where a managing agent is involved, the landlord should confirm in writing which party is discharging the fire safety duties.
