Legal & Regulatory Requirements for Nurseries

The Early Years Foundation Stage (EYFS) Statutory Framework 2024 requires all Ofsted-registered early years providers in England to conduct risk assessments. Welfare requirement 3.64 requires providers to carry out a risk assessment for any activity or environment that presents a risk of injury to children. Welfare requirement 3.67 requires that risk assessments are reviewed regularly — and whenever there is a significant change to the provision, a near-miss, or following any incident. These requirements apply equally to nurseries, pre-schools, childminders, and all other registered early years settings.

Under the Health and Safety at Work Act 1974 and the Management of Health and Safety at Work Regulations 1999, all employers — including nursery operators — must carry out a suitable and sufficient risk assessment of their work activities. For childminders, the same duty applies as self-employed persons.

The Childcare Act 2006 places a duty on Ofsted to inspect registered early years providers against the EYFS. Inspectors check that risk assessments are in place, up to date, and appropriate for the setting. A nursery that cannot produce written risk assessments during an Ofsted inspection is at risk of receiving a ‘Requires Improvement’ or ‘Inadequate’ judgement.
