The Legal Framework for Plumbing Contractors
The Gas Safety (Installation and Use) Regulations 1998 require that all gas work in domestic and commercial premises is carried out by a Gas Safe registered engineer. It is a criminal offence for an unregistered person to carry out gas work. Plumbing contractors who are not Gas Safe registered must not work on gas supplies, pipework or appliances, and their risk assessment must clearly state this boundary and the procedure for isolating gas supplies safely before work begins.
For work involving water supply systems, the Water Supply (Water Fittings) Regulations 1999 (WRAS) set out requirements for the installation, alteration and repair of water fittings to prevent contamination of the water supply. Approved contractors must notify the water undertaker before starting certain types of work. Failure to comply can result in prosecution by the water undertaker.
For larger commercial or public building projects involving hot and cold water systems, L8: Legionella — The Control of Legionella Bacteria in Water Systems (HSE ACOP) and HSG274 Part 2 set out the duty of care for controlling legionella risk in hot and cold water systems. Any work that involves interrupting or reconnecting a recirculating hot water system or stored cold water (above 20°C) must consider legionella risk and the need to disinfect after reinstatement.
The Management of Health and Safety at Work Regulations 1999 (Regulation 3) require plumbing contractors to conduct a suitable and sufficient risk assessment for every job. This must cover manual handling risks (carrying pipe, fixtures and tools), working in confined spaces (under-floor or loft access), lone working, and exposure to lead pipework (lead pipe replacement triggers COSHH requirements).
