Food Safety Act 1990 and HACCP

Section 7 of the Food Safety Act 1990 makes it a criminal offence to render food injurious to health. Article 5 of Regulation (EC) No 852/2004 — implemented by the Food Hygiene (England) Regulations 2006 — requires all street food operators to maintain a HACCP-based food safety management system. This applies to all food business operators regardless of size, including sole traders at market stalls and pop-up events.

DSEAR 2002 and LPG Safety

The Dangerous Substances and Explosive Atmospheres Regulations 2002 (DSEAR) apply to street food operations using LPG. Regulation 5 requires a risk assessment for dangerous substances. LPG cylinders must be stored upright, away from ignition sources, and in accordance with BS 5482. Equipment must be serviced by a Gas Safe registered engineer. Many market operators and local authorities require sight of a current DSEAR risk assessment before permitting LPG use on site.

Street Trading Licensing

Street trading on public land in England is regulated by Schedule 4 of the Local Government (Miscellaneous Provisions) Act 1982. Local authorities designate streets as ‘consent streets’, ‘licence streets’, or ‘prohibited streets’. A street trading licence or consent is required in most locations. A risk assessment is typically required as part of the licence application. Trading without a licence or in a prohibited street is a criminal offence. Trading Standards officers have powers to inspect and enforce compliance.

MHSWR 1999 and Allergen Law
