Legal requirements for childminders

The Early Years Foundation Stage (EYFS) Statutory Framework (updated September 2021) requires all registered childminders to complete written risk assessments covering anything with which a child may come into contact. This includes your premises, equipment, activities, and outings. Section 3.65 of the EYFS framework states that providers must determine where it is helpful to make a written risk assessment in relation to specific issues, and Ofsted expect to see evidence of this during inspections.

Under the Health and Safety at Work Act 1974 and Regulation 3 of the Management of Health and Safety at Work Regulations 1999, childminders are legally required to assess risks to children, parents, and themselves, and to put sensible measures in place to control those risks. This applies whether you work alone or employ an assistant. A written risk assessment demonstrates compliance and is the first document Ofsted will ask to see.

Childminders must also comply with safeguarding requirements under the EYFS framework, including safer recruitment, supervision, and child protection policies. While safeguarding policies are separate documents, your risk assessment should reference safeguarding controls such as visitor procedures, secure entry systems, and supervision arrangements.
