What is a confined space under UK law?

A confined space is defined under the Confined Spaces Regulations 1997 as any place, including any chamber, tank, vat, silo, pit, trench, pipe, sewer, flue, well or other similar space where there is a reasonably foreseeable risk of serious injury from hazardous substances or conditions within the space or a lack of oxygen. This includes excavations deeper than 1.2 metres, manholes, storage tanks, boilers, sewers, and any substantially enclosed space where gas build-up or oxygen depletion is possible.

Regulation 3 requires that no person shall enter a confined space to carry out work unless it is not reasonably practicable to achieve the purpose of that work without such entry. This means you must first consider whether the work can be done from outside the space. If entry is unavoidable, Regulation 4 requires a suitable and sufficient risk assessment identifying the hazards and the precautions to be taken before, during and after entry.
