Legal requirement for workplace fire risk assessments

Under Article 9 of the Regulatory Reform (Fire Safety) Order 2005 (RRO), the 'responsible person' — typically the employer, building owner or managing agent — must carry out a suitable and sufficient fire risk assessment for all workplaces and commercial premises in England and Wales. Equivalent legislation applies in Scotland (Fire Safety (Scotland) Regulations 2006) and Northern Ireland (Fire and Rescue Services (Northern Ireland) Order 2006).

The fire risk assessment must identify fire hazards, people at risk, evaluate the risk level, and record control measures including fire detection, alarm systems, emergency lighting, evacuation procedures and staff training. Where five or more people are employed, or the premises are licensed or subject to an alterations notice, the assessment must be recorded in writing.

The Fire Safety Act 2021 clarified that the RRO applies to external walls and building structure, including cladding and balconies. Building owners and managing agents must now assess fire spread risks on the building exterior, particularly for high-rise residential and mixed-use buildings.

Fire and rescue authorities enforce the RRO through inspections and can issue enforcement notices, prohibition notices or prosecute where fire safety standards are not met. Over 3,000 enforcement notices were issued in England in 2022/23. A suitable fire risk assessment is your primary defence against enforcement action and prosecution.

Frequently Asked Questions

Is a fire risk assessment legally required for my workplace?

Yes. Under Article 9 of the Regulatory Reform (Fire Safety) Order 2005, every employer, building owner or person with control of premises must carry out a fire risk assessment. This applies to all workplaces, commercial premises and shared buildings in England and Wales. Equivalent legislation applies in Scotland and Northern Ireland.

Does this meet Regulatory Reform (Fire Safety) Order 2005 requirements?

Yes — every fire risk assessment is written to comply with Article 9 of the RRO 2005 and includes identification of fire hazards, people at risk, evaluation of risk levels, and documented control measures including fire detection, means of escape and staff training.

Do I need a site visit to complete the fire risk assessment?

No — you describe your workplace layout, fire safety systems and hazards, and Anyrisks produces a compliant fire risk assessment based on your input. However, you remain responsible for ensuring the information you provide is accurate.

Can I use this for a multi-storey building or complex premises?

Yes — describe the building structure, number of floors, compartmentation, stairways and any sleeping accommodation or vulnerable persons. The fire risk assessment will reflect the complexity of your premises and include all relevant fire safety measures.

Will the fire authority accept this fire risk assessment?

Anyrisks produces a regulation-compliant, fully written fire risk assessment in the standard format expected by fire and rescue authorities. It addresses all areas assessed during fire safety inspections under the RRO 2005.

How often should I review my workplace fire risk assessment?

The RRO 2005 requires fire risk assessments to be kept under review and updated when there are significant changes to the premises, occupancy, fire safety systems or following a fire incident. Many organisations review annually as good practice.

Does it cover external wall fire safety and cladding?

Yes — mention if your building has cladding, external insulation or concerns about external wall construction. The assessment will address Fire Safety Act 2021 requirements for external fire spread, particularly relevant for high-rise and mixed-use buildings.

Can I edit the fire risk assessment after download?

Yes — you receive both a PDF and an editable Word document. You can update specific details, add site plans or annotate control measures as needed.
